These Terms & Conditions (“Terms”) govern the purchase of products and the use of services offered by Cryptvice via www.cryptvice.com.

Effective April 23, 2023

Translations of these Terms may be provided for convenience only. In the event of any discrepancy, the English version shall prevail.

Article 1 — Definitions
  • Kriptë: Cryptvice, operating from Spain, trading via www.cryptvice.com.
  • Klient: Any individual or legal entity purchasing products or services from Cryptvice.
  • Konsumator: A natural person acting for purposes outside their trade, business, or profession, as defined under EU law.
  • Business Customer: Any Customer acting for professional, commercial, or trade purposes.
  • Agreement: Any contract concluded between Cryptvice and the Customer under these Terms.
  • Products: Physical goods, including hardware devices and accessories, offered by Cryptvice.
  • Services: Any supplementary or related services provided by Cryptvice.
  • Porosit: A purchase request submitted by the Customer via the website or other accepted communication channels.
Article 2 — Scope & applicability

These Terms apply to all offers, orders, and agreements relating to Products and Services provided by Cryptvice, unless explicitly agreed otherwise in writing.

By placing an Order, the Customer confirms that they have read, understood, and accepted these Terms without reservation.

Any terms proposed by the Customer are expressly rejected unless accepted in writing by Cryptvice.

Article 3 — Formation of contract

Product listings and prices on the website constitute an invitation to place an order, not a binding offer.

A contract is formed only once:

  1. The Customer submits an Order, and
  2. Cryptvice confirms acceptance via email or written confirmation.

Cryptvice reserves the right to refuse or cancel Orders at its discretion, including but not limited to availability issues, pricing errors, fraud prevention, or regulatory constraints.

Article 4 — Prices & taxes

All prices are shown in EUR and include VAT unless stated otherwise.

Shipping costs, customs duties, import taxes, or other charges are not included unless explicitly specified during checkout.

Prices displayed at the time of Order confirmation are binding.

Article 5 — Payment terms

Accepted payment methods may include:

  • Bank transfer
  • PayPal
  • SEPA transfer
  • Cash on pickup (where applicable)
  • Cryptocurrency (where explicitly offered)

Cryptvice reserves the right to:

  • Restrict payment methods per Order
  • Delay or cancel Orders for fraud or compliance checks

For cryptocurrency payments:

  • Payment amounts are fixed at the time of invoice
  • Exchange rate fluctuations are borne by the Customer
  • Refunds cannot be issued to the original crypto wallet; alternative solutions may be offered at Cryptvice’s discretion

Failure to complete payment within the specified timeframe may result in automatic cancellation of the Order.

Article 6 — Retention of title

All Products remain the property of Cryptvice until full payment has been received.

Article 7 — Delivery & shipping

Delivery conditions, estimated delivery times, customs handling, and shipping responsibilities are governed by the Shipping & Returns Policy, which forms an integral part of these Terms.

Cryptvice is not liable for delays caused by couriers, customs authorities, force majeure events, or incorrect delivery details provided by the Customer.

Article 8 — Right of withdrawal (Consumers)

Consumers have a statutory right to withdraw from the Agreement within 14 calendar days of receiving the Products, in accordance with EU consumer protection law.

The right of withdrawal does not apply to:

  • Custom-made or hardware-modified Products
  • Products sealed for security reasons once unsealed
  • Activated software or licenses
  • Business Customers

Article 9 — Returns & refunds

Returns, refund eligibility, return shipping costs, and refund timelines are governed exclusively by the Shipping & Returns Policy.

Refunds are issued using the original payment method unless otherwise agreed.

Article 10 — Warranty & conformity

Consumers

Consumers benefit from statutory warranty rights under applicable EU law.

Business Customers

For Business Customers:

  • Warranty for new Products is limited to 12 months from delivery
  • Cryptvice may choose repair or replacement at its discretion

Warranty does not cover:

  • Normal wear and tear
  • Improper use or modification
  • Software activation performed at Customer request
Article 11 — Risk transfer

For Consumers, risk transfers upon physical receipt of the Products.

For Business Customers, risk transfers upon delivery to the courier.

Article 12 — Limitation of liability

Cryptvice is not liable for indirect or consequential damages, including loss of profit, data, or business interruption.

Liability is limited to the total amount paid for the relevant Order, except where liability cannot be excluded by law, including:

  • Death or personal injury
  • Gross negligence or intentional misconduct
Article 13 — Force majeure

Cryptvice is not liable for failure or delay caused by events beyond reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions, government actions, or transport failures.

Article 14 — Use of customer references

Business Customers may be referenced publicly (e.g., company name or logo) unless they object in writing.

Article 15 — Governing law & jurisdiction

These Terms are governed by the laws of Spain.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain, unless mandatory consumer law provides otherwise.

Article 16 — Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Article 17 — Amendments

Cryptvice reserves the right to update these Terms at any time. Updated Terms will be published on the website and apply to future Orders.
